HAI PHONG ECONOMIC ZONE AUTHORITY Hai Phong has its own headquarters and Management Board Representative Office located in industrial parks and economic zones in the city, affiliated public service units include: Intermediate School Economic Zone, Center for Investment Promotion and Employment Services of Economic Zone.
Decision No. 09/2018/QD-UBND dated January 05, 01 of the People's Committee of Hai Phong city clearly stipulates the tasks and powers of the HAI PHONG ECONOMIC ZONE AUTHORITY as follows:
A. Duties and powers of the Management Board for industrial parks and export processing zones (hereinafter collectively referred to as industrial parks):
1. Submit to the City People's Committee:
a) Draft document stipulating the functions, tasks, powers and organizational structure of the Management Board;
b) Draft document stipulating conditions and title standards for Heads and Deputy Heads of specialized departments and Directors and Deputy Directors of units under the Management Board;
c) Draft project for establishment and reorganization of public service units according to the provisions of law;
d) Regulations on coordination of work with specialized agencies under the City People's Committee and other relevant agencies and units to carry out assigned tasks and powers according to the one-stop, one-stop mechanism. interconnecting door;
d) Draft planning project, adjustment and supplementation of development planning for industrial parks and economic zones;
e) Annual and 5-year plans for industrial park and economic zone development, human resource development and development investment capital;
g) Draft decisions, directives, documents; Programs and measures to organize the implementation of state administrative reform tasks in the field of industrial parks and economic zones under the management scope of the Management Board according to the provisions of law.
2. Submit to the Chairman of the City People's Committee:
a) Draft decision to establish, merge, split, reorganize, and dissolve organizations and units under the Management Board according to the provisions of law;
b) Draft documents under the promulgation authority of the Chairman of the City People's Committee in the field of industrial parks and economic zones.
3. Help the City People's Committee manage the use of state budget capital to invest in construction and development of industrial parks and economic zones;
4. Guide, organize and inspect the implementation of legal documents, planning, plans, schemes, projects, mechanisms and policies on industrial parks and economic zones after being approved. execute, approve; information, propaganda, guidance, dissemination, and monitoring of law enforcement on industrial parks and economic zones in Hai Phong city.
5. Regarding investment management:
a) Receive, issue, adjust and revoke Investment Registration Certificates for investment projects under its authority according to the provisions of investment law;
b) Organize investment promotion activities according to plans approved by the Ministry of Planning and Investment, ministries and branches and the City People's Committee; Participate in investment promotion programs in industrial parks and economic zones organized by the Ministry of Planning and Investment, ministries and branches and the City People's Committee; Guide and support investors according to authority in the process of preparing and implementing investment projects; Periodically report investment promotion activities to the Ministry of Planning and Investment and the City People's Committee according to the State management regulations on investment promotion issued together with Decision No. 03/2014/QD-TTg dated January 14, 01 of the Prime Minister;
c) Resolve difficulties and problems of investors; Evaluate investment efficiency in industrial parks, export processing zones, and economic zones; Quarterly, every six months and annually, send reports on investment activities and production and business activities in industrial parks and economic zones to the City People's Committee and the Ministry of Planning and Investment according to regulations .
6. Regarding environmental management:
a) Organize appraisal and approval of environmental impact assessment reports for projects in industrial parks and economic zones as authorized by the City People's Committee (for projects under the authority of the City People's Committee). City People's Committee);
b) Receive registration and confirmation of environmental protection plans for subjects required to register in industrial parks and economic zones as authorized by the Department of Natural Resources and Environment and the District People's Committee, district (for projects under the jurisdiction of the District People's Committee);
c) Organize appraisal and approval of detailed environmental protection projects and simple environmental protection projects of projects in industrial parks and economic zones as authorized by competent authorities;
d) Organize inspection and confirmation of completion of environmental protection works to serve the project operation phase for investment projects in industrial parks and economic zones according to the law on environmental protection.
7. Regarding planning and construction management:
a) Adjust the approved detailed construction planning of the industrial park and functional areas in the economic zone but do not change the land use function and planning structure;
b) Appraisal of basic designs for group B and C investment projects subject to appraisal in industrial parks and economic zones;
c) Issuing, adjusting, extending, reissuing, and revoking construction permits for construction works in industrial parks and economic zones that require a construction permit as decentralized or authorized by the Committee city people;
d) Carry out tasks of planning management, construction, and quality of works in industrial parks and economic zones according to legal regulations on construction and decentralization and authorization of competent authorities. .
8. Carry out state management tasks on labor according to the guidance of the Ministry of Labor, War Invalids and Social Affairs in Circular No. 32/2014/TT-BLDTBXH December 01, 12 specifically as follows:
a) Receive explanatory reports from enterprises in industrial parks and economic zones about the need to use foreign workers for each job position that Vietnamese workers cannot meet, synthesize, submit to the Chairman of the City People's Committee for decision under the authorization of the City People's Committee;
b) Issuing, re-issuing, and revoking work permits for foreign workers working in industrial parks and economic zones; confirm that foreign workers working for businesses in industrial parks and economic zones are not subject to work permits as authorized by the Department of Labor, War Invalids and Social Affairs;
c) Organize the registration of labor regulations and receive collective labor agreements as authorized by the City People's Committee; Receive registration of salary scale systems, payroll, and labor norms of enterprises in industrial parks and economic zones as authorized by the District People's Committee;
d) Receive notices about layoffs of many workers, reports on labor sublease, results of training and fostering to improve qualifications and annual vocational skills of enterprises in industrial parks, economic zone authorized by the City People's Committee;
d) Receive and process registration dossiers for implementation of contracts for accepting interns from enterprises in industrial parks and economic zones, and activities of sending workers to work abroad in the form of advanced internships. highly skilled for less than 90 days as authorized by the Department of Labor, War Invalids and Social Affairs;
e) Receive reports on labor use and report changes in labor; Receive notice of organizing overtime work from 200 hours to 300 hours per year by enterprises in industrial parks and economic zones as authorized by the Department of Labor, War Invalids and Social Affairs;
g) Receive notification of location, area, start time of operations and managers and key position holders of labor subleasing enterprises in industrial parks and economic zones as authorized by the Department Labor, War Invalids and Social Affairs;
h) Carry out labor management tasks in industrial parks and economic zones, including: ensuring labor safety, labor hygiene, building labor relations, resolving labor disputes and strikes. according to labor laws or instructions from competent authorities.
9. Regarding trade management:
a) Grant, re-issue, amend, supplement and extend the License to establish commercial representative offices of foreign organizations and traders headquartered in industrial parks and economic zones according to the guidance of the Ministry of Industry and Trade;
b) Issuing business licenses, supplementing business objectives for goods purchase and sale activities and activities directly related to goods purchase and sale for foreign-invested enterprises and foreign investors Invest in industrial parks and economic zones according to the provisions of law, instructions of the Ministry of Industry and Trade and authorization of the City People's Committee;
c) Issuing, re-issuing, amending and supplementing various types of Business Eligibility Certificates and Business Licenses for a number of goods within the scope of specialized management for traders with headquarters and business establishments in industrial parks and economic zones according to the guidance of the Ministry of Industry and Trade;
d) Issue certificates of origin for goods produced in industrial parks and economic zones according to the guidance and authorization of the Ministry of Industry and Trade.
10. Regarding land and real estate management:
a) Receive registration of land rental price brackets, land sublease and infrastructure fees for industrial parks and economic zones from investors constructing and trading infrastructure of industrial parks, export processing zones and economic zones. Other functions and tasks related to real estate business management according to the provisions of law;
b) The Management Board performs functions and tasks related to land specified in Article 151 of Land Law No. 45/2013/QH13 and Article 53 of Decree No. 43 / 2014 / ND-CP dated May 15, 5 of the Government detailing and guiding the implementation of a number of articles of the Land Law, Decree No. 2014/135/ND-CP dated September 2016, 09 amending and supplementing a number of articles of Decrees regulating the collection of land use fees, land rent, and water surface rent.
11. Issue some types of licenses and certificates in industrial parks and economic zones according to the authority, guidance and authorization of ministries, city People's Committees and competent agencies.
12. Other tasks and powers:
a) Carry out international cooperation in the field of industrial park and economic zone development according to the provisions of law and assignment or authorization of the City People's Committee and Chairman of the City People's Committee;
b) Organize research and application of scientific and technical advances; Build an information and storage system to serve state management and professional expertise in assigned fields;
c) Organize inspection and handle according to authority or propose competent authorities to handle violations of law in the fields of investment, environment, labor, trade, and construction within the scope of management. State management is decentralized and authorized by the Management Board; Participate in inspections and organize the settlement of complaints and denunciations according to the provisions of law; Implement anti-corruption, practice thrift and combat waste;
d) Manage the organizational structure, civil servant payroll, structure of civil servant ranks, job positions, structure of public employees by professional title and number of people working in public service units; Implement salary regimes and policies, remuneration, training, fostering, rewards and discipline for civil servants, public employees and employees under the management of the Management Board according to the provisions of the Law. by law and according to the decentralization or authorization of the City People's Committee;
d) Manage and take responsibility for finances and assigned assets according to the provisions of law;
e) Carry out information work, periodic and irregular reports on the implementation of tasks in assigned work areas with the City People's Committee, the Ministry of Planning and Investment and other ministries and branches relate to; receive statistical reports and financial reports of enterprises operating in industrial parks and economic zones; Build an information system on industrial parks and economic zones in the area and connect with the national information system on industrial parks and economic zones;
g) Organize emulation and reward movements for businesses in industrial parks and economic zones;
h) Perform other tasks and powers as prescribed by law and assigned and authorized by the City People's Committee and Chairman of the City People's Committee.
B. Duties and powers of the Management Board for Dinh Vu - Cat Hai Economic Zone
In addition to the duties and powers mentioned above Article A Under this regulation, the Management Board also has the following duties and powers:
1. Develop and submit to the City People's Committee to submit to the Prime Minister for decision according to authority:
– Project bond issuance plan; Plan to mobilize other capital sources to invest in developing important technical and social infrastructure systems in the economic zone.
2. Develop and submit to ministries, branches and the City People's Committee for approval and organize implementation:
a) Detailed planning for construction of functional subdivisions in accordance with the approved general planning for construction of the economic zone, detailed land use planning and plans in the economic zone submitted to the City People's Committee for approval;
b) List of investment projects and annual and 5-year development investment capital plans submitted to competent authorities for approval or self-approval according to authority;
c) Develop price frames and fees and charges applied in economic zones and submit them to competent state agencies for promulgation according to the provisions of law;
3. The Management Board directs or organizes the implementation of the following tasks:
a) Hire foreign consultants to perform: Investment promotion consulting services, investment strategy consulting on construction and economic zone development; Detailed planning of functional areas such as tourist areas, urban areas and non-tariff areas in economic zones.
b) Decide to invest in group B and C projects using state budget capital invested in economic zones as authorized by the City People's Committee;
c) Sign BOT, BTO, BT contracts for group B and C projects as authorized by the City People's Committee; directly receive, manage and use ODA capital;
d) Manage and use investment capital sources for economic zone development under authority; investment and construction management for investment projects with development investment capital from the State budget in economic zones under its jurisdiction; Manage and implement administrative and non-business revenues and expenditures, target programs and other assigned capital sources according to the provisions of law.
d) Take the lead in coordinating with relevant agencies to carry out maintenance and repair of the system of technical and social infrastructure works, public service and utility works invested from the budget. government in economic zones.
e) Effectively manage and use allocated specialized land and water surface funds according to their intended use and in accordance with the general planning for construction of economic zones, detailed planning for construction of functional areas, Land use planning and plans have been approved by competent authorities.
g) Re-allocation of land with collection of land use fees, re-allocation of land without collection of land use fees, lease of land, water surface and implementation of land management in economic zones according to the provisions of land law.
h) Based on the regulations of the City People's Committee and the law on investment and land, decide on the level of collection of use fees, rents and exemptions for specialized land and water surfaces for each project. Investment projects apply to cases of land re-allocation or land lease without auction or bidding for land use rights.
i) Coordinate with local authorities and relevant agencies to ensure all activities in the economic zone are consistent with operating regulations and planning, construction and development plans of the economic zone have been approved by the agency. The State has the authority to approve and related regulations.
k) Collect fees or charges for using infrastructure and public utilities in the economic zone according to the provisions of law on fees and charges.
